Title: Toerag in stolen car kills two.
Post by: Walt Zingmatilder on August 31, 2016, 07:29:31 PM
A piece of shit has killed a woman and a boy after crashing an alleged stolen car into a group of people. The gutless excrement was caught trying to run away from it's responsibilities.

Never mind he will face the full force of the law.

How long do we think he might spend in prison.

My guess, less that a 5 years, and it will the police who were to blame for trying to catch him.

The car was reported as actually stolen not allegedly stolen tonight.

I think cases like this should be treated as murder charges.

You can't. You'd have to prove intent to kill. It's likely that this would not be possible.

The toerag should be sent down for a long time but I suspect it will be causing death by dangerous driving, so not likely.

Except given that he was driving to escape the police, there is a good chance this will be seen as a maximum culpability case and sentence could be up to 14 years

One hopes so.

But, for murder, the prosecution will have to prove the intent to kill these poor people. Showing that they were trying to escape police won't add anything to a murder charge.

Didn't say it would lead to a murder charge, just pointing out that the sentencing is different in death by dangerous driving cases based on what is seen as culpability - in the case of escaping from the police that is generally taken as maximum culpability and can lead to a sentence of up to 14 years

This is a terrible case.  I caught the end of it on the news yesterday and when I noted it was SE London I wondered if it had happened anywhere near me (not that that would make any difference);  later on I learned that it was in Penge which isn't my way.

Poor souls, who would go out to a park with a little one and expect something like that to happen?   We really never do know the minute nor the hour.

Thank goodness the police caught the lad responsible.  He'll certainly feel the full force of the law, rightfully so, and have the rest of his life to deal with it.

I would argue that driving a car in the manner in which this man did shows intent. He had a complete disregard for human life and was prepared to kill anybody who got in his way.

I don't disagree. Intent to get away with scant regard to the possible impact to others, but the prosecution would never be able to show an intent to kill these people.
