The question itself is too black and white in imagining that blame is a 100% thing. It also doesn't allow for the difference in context. I do hope that the case fails.

It does seem an impossible thing to apportion blame in a case like this.
Are they culpable - yes, probably.
However, I struggle to see how this could be made to stick in any Western judicial system.
